A new priority court in Durban aims to simplify the handling of immigration cases for quicker resolutions.
Reporting by SABC News link has revealed that a new priority court has been set up in Durban to expedite immigration cases. This initiative, a collaboration between the Department of Home Affairs and the Department of Justice and Constitutional Development, comes in response to the discovery that nearly 2,000 Malawian nationals are living in South Africa illegally.
The priority court will function virtually under the jurisdiction of the Durban Magistrate’s Court. Its primary goal is to accelerate the processing of deportation orders and ensure compliance with immigration laws. Thulani Mavuso, spokesperson for the Department of Home Affairs and Deputy Director-General for Operations, explained the situation: “1,876 Malawian nationals have been confirmed to be residing in the Republic in contravention of South Africa’s immigration laws. The verified contraventions include visa overstays, expired travel documents, and undocumented status, all of which constitute grounds for deportation in terms of our immigration act.”
Virtual Court Operations
The virtual court will operate from Sherwood Park, facilitating the consideration and confirmation of deportations for those affected. This setup aims to simplify the legal process and address the backlog of immigration cases more efficiently. To date, the government of Malawi has assisted in the return of 676 of its nationals.
