The O-1B Visa is designed for individuals with extraordinary ability or achievement in the arts, motion picture, or television industry. To qualify for this visa, applicants must have received, or been nominated for, significant national or international awards such as an Oscar, Emmy, Grammy or Director's Guild Award, or show evidence of comparable recognition. If this standard is not met, alternative evidence showing the individual's extraordinary ability can also be submitted.
Like the O-1A Visa, the O-1B allows individuals to live and work in the United States. The initial period of stay can be up to three years, with the possibility of extensions granted in one-year increments. The O-1B Visa also has no annual cap, making it a flexible option for those who qualify.
To apply for the O-1B Visa, a petition must be filed by a U.S. employer, an agent, or a foreign employer with the USCIS. The application requires substantial documentation to support the applicant's extraordinary achievement, including evidence of the applicant's original contributions of major significance to the field.
