The Australian Employer Nominated Scheme (Subclass 186) is a permanent residency visa that allows Australian employers to sponsor skilled foreign workers to work in Australia in occupations that are in high demand. The visa has three streams, namely the Temporary Residence Transition Stream, the Direct Entry Stream and the Agreement Stream.
Pathways
To be eligible for the Temporary Residence Transition Stream, an applicant must hold a Temporary Skill Shortage (TSS) visa, have worked with the same employer who is sponsoring them for at least 3 years in a full-time position, and meet the required English language proficiency.
The Direct Entry Stream is available for those who have not worked in Australia, or have worked in Australia for less than 3 years. This stream requires a skills assessment, at least 3 years of work experience in the relevant occupation, and meeting the English language requirements.
The Labour Agreement Stream is for those who are sponsored by an employer under a labour agreement.
Validity and Financial Requirements
The Subclass 186 visa is a permanent residency visa, allowing the visa holder to stay and work in Australia indefinitely. The visa holder must also be able to financially support themselves and any dependents during their stay in Australia. There are also certain costs associated with the visa application process, such as the application fee, health assessments, police clearance certificates and any additional costs related to skills assessment, English language proficiency tests, and so on.
Obligations
Once granted the Subclass 186 visa, the visa holder must adhere to certain obligations. They must work for their sponsoring employer for at least 2 years after the visa has been granted, unless there are certain exceptional circumstances. Additionally, the visa holder must notify the Department of Home Affairs if there are any changes in their circumstances, such as a change in address, contact details or employment status. The visa holder must also comply with all Australian laws and regulations, including tax and superannuation obligations.
